Legal dispute over rights

Disputes may arise between members of Koda. This section provides information on disputes involving only Koda members. The procedures described here may differ if the dispute also involves members of other societies.

When does a rights dispute arise?

A rights dispute arises where there is justified uncertainty as to who holds the rights in a work.

Typical examples of situations giving rise to reasonable doubt

  • A dispute between authors/rightsholders and publishers concerning a publishing agreement.
  • A disagreement between authors/rightsholders regarding the distribution of shares in a work.
  • A claim that a work constitutes plagiarism.

There is no justified doubt where a disagreement can be resolved through administrative means alone, for example by applying Koda’s distribution rules.

Typical examples of situations not giving rise to justified doubt

  • Where the conditions for an agreed allocation or processing share have not been fulfilled.
  • Where the limit for the publisher’s share has been exceeded.
